  1. Product Usage & Capacity Limits

1.1. Recommended Capacity: Each product (including but not limited to Albums and Slip Cases) is designed for a specific maximum capacity as indicated on the product packaging, website description, or physical label.
1.2. Misuse through Overfilling: Customers are strictly advised not to exceed these stated limits. "Overfilling" refers to the insertion of contents beyond the point where the product can close naturally without force, or beyond the specified page/item count. 

 

  1. Limitation of Liability for User-Inflicted Damage

2.1. Self-Damaged Goods: We hold no liability for "self-damaged" goods where the damage is a direct result of exceeding the recommended maximum capacity.
2.2. Excluded Damages: This exclusion specifically applies to structural failures caused by overfilling, such as: 

  • Split or cracked Albumspines/seams.
  • Distorted, torn, or burst Slip Cases.
  • Broken hinges, rings, or binding mechanisms due to excessive internal pressure.
    3. Warranty Voidance:Damage resulting from such misuse is not considered a manufacturing defect and is not covered under our standard warranty or the Australian Consumer Law (ACL) guarantees of "acceptable quality". 

 

  1. Claims & Assessments

3.1. Inspection Right: We reserve the right to inspect any returned item to determine if the failure was caused by a manufacturing defect or by misuse (overfilling).
3.2. Mandatory ACL Statement: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. However, these rights do not apply if the damage was caused by abnormal use or failure to follow reasonable instructions (such as capacity limits). 

 

  1. Postage and Transit Damage

4.1. Risk Transfer: Risk of loss or damage to the goods passes to the Customer upon delivery of the goods to the Customer's nominated shipping address.
4.2. Reporting Damage: Customers must inspect all items immediately upon receipt. Any damage suspected to have occurred during transit must be reported to us in writing: 

  • Visible Damage:Within 7 days of delivery if the recipient has confirmed damage at the point of receipt.
  • Concealed Damage:Within 24 hours (or one business day) if the package appeared in good order upon initial receipt but contents are found damaged.
    3. Evidence Required: To process a claim for transit damage, Customers must provide:
  • Photographic evidence of the damaged product.
  • Photographic evidence of the external and internal packaging.
  • Proof of purchase (e.g., order number or receipt).
    4. Packaging Responsibility:We ensure all items are packed securely to withstand standard transit risks. We are not liable for damage resulting from a carrier's gross negligence, provided the item was dispatched in appropriate protective packaging.
    4.5. Courier Liability Limits: Most standard delivery services include capped compensation (e.g., Australia Post typically caps standard cover at $100).
    4.6. Extra Cover: For high-value items, we strongly recommend purchasing additional Transit Protection or "Extra Cover" at checkout to ensure full replacement value is protected. 

 

  1. Returns & Refunds (Transit Related)

5.1. Assessment: If we confirm a product was damaged in transit (and not through overfilling or misuse as per Section 2), we will offer a repair, replacement, or refund in accordance with the Australian Consumer Law (ACL).
5.2. Return Costs: If a product is confirmed to have been damaged prior to or during delivery, we will reimburse the Customer for reasonable return postage costs.
5.3. Exclusions: We do not provide refunds or replacements for damage caused by the Customer after delivery, including damage during unpacking or through subsequent overfilling.
